IBNESTO Terms of Use and Terms of Service Agreement

For the purposes of this Terms of Use and Terms of Service agreement, “IBNESTO”, “we”, “us”, and “our” refer to the International Business Network of Engineering, Science and Technology Organizations, operated by Caweem LLC, the company.

By continuing to use and access this website and/or our services, you agree to abide by the following Terms of Use and Terms of Service.

Copyrights and Trademarks

All content on the ibnesto.com website, including but not limited to all text, images, videos, design, code, animations, and excluding user-generated content or content published under permission by third-parties, is the Intellectual Property of IBNESTO, and is protected by United States and International copyright laws.

You may not copy, modify, publish, adapt, transmit, reproduce, create new works from, exploit in any way or form, or participate in the transfer or sale of any content in whole or in part, without the prior written permission of IBNESTO.

You may not use any IBNESTO logos, proprietary graphics or trademarks without our written permission.

You are granted permission, subject to the restrictions in this agreement, to access, download (on temporary storage only), display, view, or print the material on this website, for non-commercial use only, provided that you appropriately link to ibnesto.com and cite ibnesto.com as the source.

User Content

In the context of this agreement, User Generated Content or User Content is content that is submitted by the users of our website and services, including but not limited to any text, images, videos, audio, location data, reviews, ratings, comments, messages, or any other information that is publicly displayed and was submitted by a user of our website and/or our services.

Although IBNESTO requires all users to affirm that any information and content that they submit is fully accurate, IBNESTO does not verify the accuracy of the information submitted by the users, except for verifying the identities of organizations with the help of government issued documents supplied by the users submitting the respective listing.

By submitting User Content on any page of the ibnesto.com website, you represent and warrant that:

  • You have been authorized by the organization being listed to submit content that is an intellectual property, a copyright or trademark of the organization being listed or if you are the owner of the intellectual property protected User Content that you submit;
  • All content that you upload to our website is accurate to the best of your knowledge;
  • You are solely responsible for any listings, reviews, contributions, comments, or any other form positing or uploads, including feedback and questions;
  • Your submission or use of the user content does not violate this agreement;
  • Your submission will not cause any injury to any person or entity;
  • You will indemnify, defend, and hold harmless IBNESTO, its members, employees, contractors and partners including Caweem LLC and their members and employees, from any third party claims and damages, losses or injuries resulting from the display of your user content;
  • You will not submit any user content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, hateful, racially discriminatory, ethnically discriminatoryor otherwise objectionable;
  • You will not submit any user content that infringes any patent, trademark, trade secret, copyright or other proprietary or intellectual property rights of any entity;
  • You will not submit any user content that contains malicious software viruses or any other computer code or program that is designed interrupt, destroy or limit the functionality of any of our systems including our software systems, our hardware systems or our network systems;
  • You will not submit any user content that is false, inaccurate, or misleading;
  • You will not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • You will not infringe on the privacy rights of others by uploading their personal details without their prior permission;
  • You will not violate any local, state, provincial, territorial, national or international law, intentionally or unintentionally;
  • You are at least 18 years old

For all content that is uploaded on IBNESTO, ownership rights of the content of an organization is retained by that respective organization.

By submitting any content to our website, you grant IBNESTO and its affiliates a royalty-free, perpetual, world-wide license to use reproduce, create derivative works from, publish, modify, edit, distribute, translate, perform and display the content in any media or medium, form or format.

If we believe that any content uploaded to IBNESTO is in breach of this agreement or may cause harm to IBNESTO or our users, we reserve the right to remove, edit, refuse or permanently delete any user submitted content, even if such content does not violate this Agreement.

Services

In this Terms of Service contract, services refers to any and all of the services provided by IBNESTO  including but not limited to, getting listed on the IBNESTO directory, getting featured on IBNESTO by paying an extra premium for sponsorship and advertisement,

In the context of this agreement, services also refers to the services provided by our Web Services partner Caweem LLC, including, but not limited to, web design and web development services, search engine optimization (SEO) services, pay-per-click (PPC) management services, WordPress web design services, e-commerce web design and web development services, and any other services that we provide, in conjunction with Caweem LLC.

Payments, Pricing and Taxes

All prices quoted on on our website do not include any applicable Sales Taxes or other taxes, unless otherwise specified.

In any case, you are solely responsible for any applicable state, federal or provincial taxes.

Although we may not charge you any taxes, you agree that you will pay any applicable taxes or fees to your local or state tax agency for any purchases.

We are not responsible for collecting, transmitting, or advising on taxes, duties, or other levies by the government regarding your purchases.

Refunds Policy

All listing fees and fees for all of our services are non-refundable. 

Affiliate Terms

If you register as an affiliate of IBNESTO, you agree to abide by all the terms contained in our Affiliate Program Terms listed here.

Governing Law

All use of our website and services shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, under all circumstances.

You agree that you will notify IBNESTO in writing of any claim or dispute concerning or relating to your use of our website and services and give IBNESTO a reasonable period of time to address it before bringing any legal action against IBNESTO or our partner Caweem LLC.

You also agree to submit to the jurisdiction of the state and federal courts located in the State of Delaware, United States of America.

Limitation of Liability

To the extend permitted by law, the members, employees and contractors of IBNESTO and Caweem LLC, will not be liable, under any circumstances, for any kind of indirect, consequential, incidental, special, exemplary or punitive damages, including, but not limited to, damages for loss of profits, revenues, business, cost savings, data, or other financial losses.

You also agree that, to the extent permitted by law, the aggregate liability of IBNESTO, for any claims under these terms, is limited to the amount you have paid us for our services.

Indemnity

You agree to indemnify the members, employees and contractors of IBNESTO and Caweem LLC, against any liabilities, damages, claims, losses, fines, suits, litigation costs, and legal fees, arising out of or relating to your inappropriate or unlawful use of our services or violation of our Terms of Use and Terms of Service contained herein.

Third Party Links

Our website and services may contain link(s) to other third party websites. You understand and agree that IBNESTO has no control over any such third-party websites or the content of these websites, and thus, IBNESTO will not be liable for any damages arising out of your use of these third-party websites or their content.

Furthermore, IBNESTO does not bear any responsibility for any legal documents, practices or the content of any third-party websites.

You acknowledge and agree that third-party links on our website may be sponsored links that allow us to receive compensation from such links.
